Southern Claims Commission Petition for Jacob Byerley

Jacob Byerley filed a claim with the Southern Claims Commission.  It was no. 18955.

No. 18955, claim of Byerly, Jacob of Rhea County, State of Tennessee for $605.30 was processed in 1873.  Testimony was provided by Jacob Byerley, F. A. Fisher, Cornelius Shaver, Green McDonald and Jasper Byerly and taken before  J. R. Robinson.  W.R. Davis of Georgetown, Tennessee was the attorney.  The Testimony closed on March 25, 1873.

The Petition

Jacob Byerley of near Washington, Rhea County, Tennessee respectfully represents that he is a citizen of the United States and resides at present near Washington, Rhea County, Tennessee.  That he has a claim against the United States for Col. Minty came into the neighborhood of claimant in 1863 and camped near claimant’s house and took and used his property as follows:

Timeline between October – December 1863:

  • 75 bushels of corn at 1.00
  • 20 head of sheep 
  • 2 head of beef cattle weighing 600 lbs at 10 cents per pound net
  • 7 head hogs at 150 lbs each net at 10 c per pound (1050)
  • 2 large work oxen for beef each weighing 500 lbs net – 1000 lbs at 10 cents per pound
  • 35 bushels of wheat at 1.50
  • 5760 Rails at 3.00

Loss claimed per item:

  • Corn – $75.00
  • Sheep – $40.00
  • Cattle – $60.00
  • Hogs – $105.00
  • Oxen – $100.00
  • Wheat – $52.50
  • Rails – $172.80

That all the items in the above schedule were of the full value therein set forth and were taken from your petitioner for the use and were used by the United States Army viz Leut. Col. Robert Cline’s command to some of the articles, General  James G. Spears command took some of the articles and Col. Minty’s command took some of the them. The circumstances are as follows viz, just before and after the Chickamauga Battle these commands were stationed along the Tennessee River as guards (the River being the line) and while guarding the river they took and used claimants property.

That he never got voucher, recipt, other writing for givne thereof.

That your petitioner resided at the time and claim accrued near Washington Rhea County, Tennessee and claimant lives now near Washington Rhea County Tennessee.  That Jacob Byerley, the original owner of said claim and that Jacob Byerley the present owner of the same.

That your petitioner remained loyal adherent to the cause and the Government of the United States during the war and was so loyal before and at the time of the taking of the property for which this claim is made. That said claim has not before been presented to any department of the United States for payment and it has never been paid.

Than Wm. R. Davis, Georgetown, Tennessee, is hereby authorized and empowered to act as my attorney for the prosecution of this claim hereby revoking all others.  Wherefore your petitioner prays for such action your Honorable Commission in the premises as may be deemed just and proper.
